Ministers are required to be members of Parliament by the Constitution Act 1986. The Governor General appoints Ministers on advice of an incoming Prime minister.
All Ministers are members of the Executive Council but not all Ministers are in Cabinet. Under-Secretaries are appointed to assist Ministers and some Ministers administer their responsibilities (portfolios) outside cabinet.
Cabinet is an informal body while the Executive Council has formal functions which make it the main body for law making.
